A candidate for statewide office in South Dakota was charged with a misdemeanor for an incident over the noon hour in Sioux Falls on Tuesday.

Captain Greg VandeKamp says police were called just before 1:00 PM to Eastgate Towing on East Rice Street, where employees told officers a man had walked into their tow yard:

"This individual had gone past the open gate into he fenced in area and was attempting to retrieve his vehicle, which had been towed, I believe, earlier that day for soem unpaid parking tickets. This individual did feel that the tow yard [didn't have] the right... to tow his vehicle."

VandeKamp says rather than being arrested for burglary, 24-year-old Emmett Reistroffer of Sioux Falls was charged with unlawful occupancy.

Reistroffer is the Libertarian Party candidate for Secretary of State.
