An early morning apartment break-in on Sunday turned into a brief scuffle involving a statue.  

Police officer Sam Clemens says two windows were broken shortly after midnight and the 55-year-old apartment dweller on North Spring Avenue first called police and then went to investigate on his own.

Upon opening the door of the apartment, the suspect forced his way into the living space and grabbed a stone wolf statue nearby to make continued threats.

The victim eventually retreated to the deck on the outside of the apartment with the intruder until police arrived.  Brandon Hernandez, 37, of Sioux Falls, was arrested and charged with 1st degree burglary, intentional damage to property and simple assault.

Officials say nothing was taken from the apartment and the victim was unharmed.
